法律假期，或稱法治假期，泛指因為外部因素導致司法調查中斷。法律假期常構成民主的假象，假民主之名凌駕於司法。
發生原因[编辑]
- 連續假日，承辦案件調查的相關人員也放假去了。
- 選舉期間，為了避免影響選民的投票意向，因此凡涉及候選人的高敏感度案件，為了避免遭人利用，常擱置到選舉結束後再辦。
- 重大天然災害發生期間，常以救災優先為名，要求擱置司法調查。（這種最常見同政黨的輪番上媒體砲轟司法「政治迫害」）
- 舊法廢除，但新法尚未完成立法與公告程序的空窗期。例如預計被起訴的罪名，因舊法廢除而消失。
